  • BACKGROUND OF THE STUDY

Human right is the law or rules used to organize life between humans. Human rights are legal laws that protect individuals and groups against actions which interfere with fundamental freedoms and human dignity. They are expressed in treaties, customary international law, bodies of principles and other sources of law.

Sanctions are imposed whenever there is an infringement on human right.

Human rights are rights that every human being has by virtue of his or her human dignity. Human rights are rights inherent to all human beings. They define relationshipsbetween individuals and power structures, especially the State. Human rights delimitState power and, at the same time, require States to take positive measures ensuringan environment that enables all people to enjoy their human rights. Human rights are the sum of individual and collective rights laid down in

State constitutions and international lawGovernments and other duty bearers are under an obligation to respect, protect and fulfilhuman rights, which form the basisfor legal entitlements and remedies in case of non-fulfilment (Inter-Parliamentary Union, 2016).

Human Rights are backed by provisions of the law, forthere to be a violation of Human Rights, there must be a form of infringement of rights guaranteed under an existing law. To violate the most basic Human Rights is to deny individuals their fundamental moral entitlements. It is in a sense, to treat them if they are less than human and undeserving of respect and dignity. Examples of violations include acts typically deemed crimes against humanity such as genocide, torture, slavery, rape, deliberate starvation etc.

Nigerian security services have been accused of being one of the greatest violators of the said rights in Nigeria (Oluwaige, 2004).

Human rights in Nigeria are protected under the most current constitution of 1999. Nigeria has made serious improvements in human rights under this constitution though the American Human Rights Report of 2012 notes areas where significant improvement is needed, which include:abuses by Boko Haram, child labour, killings by governmental forces, lack of social equality, child marriage and issues with freedom of speech (Bureau of Democracy, Human Rights and Labor. Human Rights Practices for 2012. 2012).

STATEMENT OF THE PROBLEM

Human rights of individuals have been infringed upon by individuals, groups and even security groups in Nigeria. This has sometimes led to violence, riot, revolt and even war in the nation. The result of human right violation has greatly affected the nation negatively and even slowed down some development processes.

1.3     RESEARCH QUESTION

  2. Can human right violation be curbed?
  3. Are there national implications of human right violation?
  4. Can citizens contribute to the reduction of human right violation?

1.4     AIMS AND OBJECTIVE OF STUDY

The aim of this studies is to critically study the implication of human right violation in Nigeria. The objectives are:

  1. To ascertain if human rights are violated in Nigeria.
  2. To study whether human right violation can be curbed.
  3. To determine if there are implications of human right violation in Nigeria.
  4. To study if Nigerian citizens can contribute to the reduction of human right violation.

1.5     SCOPE OF THE STUDY

The idea of the research work is to study the implications of human right violation in Nigeria. It shall cover a range of Nigerian citizens airing their view about human right violation. It shall also cover a range of law enforcement agents to enlighten about the different cases they have handled on the desecration of human rights and its repercussion in Nigeria.

1.6     SIGNIFICANCE   OF   THE    STUDY                                       

This research will look critically into the implication of human right violation in Nigeria both individually and nationally. It shall enlighten the nigerian citizens about their rights and how it can be protected and also suggest measures to be taken if their rights are violated.

1.7   LIMITATION OF THE STUDY

The challenge of finance for the general research work will be a challenge during the course of study. Correspondents also might not be able to complete or willing to submit the questionnaires given to them.

However, it is believed that these constraints will be worked on by making the best use of the available materials and spending more than the necessary time in the research work. Therefore, it is strongly hoped that despite these constraint, its effect on this research report will be minimal, thus, making the objective and significance of the study achievable.
